Terms of Service
and Disclaimer.

Effective October 24, 2026

The short version. The Beach Index is an AI tool to help you generate ideas about coastal homes and towns. Use it only as a suggestion and do your own analysis. Our scores, grades, "Find your Gold" picks and return projections are AI-assisted estimates. They can be wrong. They are not financial, investment, tax or legal advice, not an appraisal, and not a recommendation that you buy or sell any property. We are not a real estate broker or agent, we don't represent you, and we are not paid when anyone buys a home. Check everything with a licensed real estate agent, a CPA and your lender before you act.

These Terms of Service ("Terms") govern your use of thebeachindex.com and its features (the "Service"), operated by The Beach Index ("we", "us"). By using the Service or creating an account, you agree to these Terms. If you don't agree, don't use the Service.

1. A tool to generate ideas, not advice

2. AI-assisted projections can be wrong

3. Data accuracy

4. No broker, agent or fiduciary relationship

5. Tax information

Depreciation, cost segregation, passive-loss and recapture figures are simplified illustrations. Tax treatment depends on your facts, such as material participation, real estate professional status, average stay length, state rules and changes in law. Talk to a CPA or tax attorney. Nothing here is intended or written to be used to avoid tax penalties.

6. Fair housing

We support the federal Fair Housing Act and California's Fair Employment and Housing Act. Our scores describe markets and properties, never people. They must not be used to discriminate against anyone based on race, color, religion, sex, gender identity, sexual orientation, marital status, national origin, ancestry, familial status, source of income, disability, veteran or military status, or any other protected characteristic.

7. Accounts, free limits and the waitlist

8. Acceptable use

Don't scrape, copy at scale, resell or republish the Service or its data. Don't reverse engineer it, overload it, get around its limits or login, or use it for anything unlawful or discriminatory. We may suspend access that breaks these Terms.

9. Our content

The Service, its design, scores and text belong to us or our licensors. You may share links and screenshots for personal, non-commercial use, with credit. Third-party data and trademarks belong to their owners.

10. Feedback

If you send feedback or ideas, we may use them without any obligation to you.

11. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that any projection will come true.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, lost investment returns, or losses from buying, selling, financing, building on or renting any property, arising from your use of or reliance on the Service. Our total liability for any claim is limited to the greater of $100 or what you paid us in the 12 months before the claim.

Some laws don't allow certain limits, so some of these may not apply to you.

13. Indemnity

You agree to defend and hold us harmless from claims that arise from your misuse of the Service or your breach of these Terms.

14. Changes

We may update these Terms. The effective date at the top will change, and continuing to use the Service means you accept the new Terms.

15. Governing law

These Terms are governed by California law, without regard to its conflict-of-law rules. Disputes will be heard in the state or federal courts located in California, unless the law requires otherwise.

16. Privacy notice
